Confirmation of Divorce & Its Legal Status

When any person is pronounce upon divorce to his wife, or if any wife got the Decree of Khula or Divorce from the Family Court , or any wife divorce herself by using her delegated powers of divorce given by her husband then notice under section 7(1) of Muslim Family Law Ordinance 1961 is given to the chairman Arbitration council for the confirmation of the divorce.

After receiving the information and notice about the divorce the chairman calls to the both the parties i.e. husband and wife and try for recompilations and if reconciliations failed then after 90 days the divorce is confirmed and a confirmation certificate is issued to the both parties under section 7(2) Muslim Family Law Ordinance 1961.

It is legal requirement for the confirmation and if confirmation is not done then under law the wife cannot contract the second marriage. But as per Islam it is not mandatory for confirmation when three irrevocable divorce is pronounce then there is no need for any reconciliations and marriage stand dissolve after ninety days either it is confirmed or not.
